If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Flexty.AI is an AI-powered platform that enables users to:

• Generate mobile app and web UI designs from text prompts
• Create and manage design projects with multiple screens
• Export generated designs as code (React, HTML/CSS)
• Share designs publicly via shareable links
• Collaborate with teams through shared subscriptions
• Customize generated components and layouts

3. Eligibility

To use Flexty.AI, you must:

• Be at least 13 years old (or 16 in the European Economic Area)
• Have the legal capacity to enter into a binding contract
• Provide accurate and complete registration information
• Maintain the security of your account credentials

4. User Accounts

4.1 Account Creation

You may create an account using:

• Email address and password
• GitHub authentication
• Google authentication

4.2 Account Responsibilities

You agree to:

• Maintain the confidentiality of your account credentials
• Not share your account with others
• Not create multiple accounts to circumvent service limitations
• Notify us immediately of any security breaches
• Be responsible for all activity under your account

5. Intellectual Property Rights

5.1 Your Content

You retain full ownership of all UI designs, code, and content you generate using Flexty.AI. We do not claim any ownership rights to your generated designs.

By using our Service, you grant us a worldwide, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of providing and improving the Service.

5.2 Our Platform

Flexty.AI owns all rights to:

• The platform technology, code, and architecture
• Component libraries and design systems
• Trademarks, logos, and branding
• Documentation and training materials

6. AI-Generated Content

6.1 Usage Rights

You may freely use, modify, and distribute AI-generated designs created through Flexty.AI for personal or commercial purposes.

6.2 No Guarantees

We do not guarantee that AI-generated content will be:

• Unique or original
• Free from errors or bugs
• Production-ready without modification
• Compliant with specific design guidelines
• Free from intellectual property conflicts

Similar prompts may yield similar results across different users. You are responsible for reviewing and validating generated content before use.

7. Subscription Plans and Billing

7.1 Plan Types

Flexty.AI offers the following plans:

• FREE: Limited projects and generation credits
• PRO: Increased project limits and monthly credits
• ENTERPRISE: Unlimited projects, team collaboration, and shared credit pool

7.2 Billing

• Subscriptions are billed monthly or annually in advance
• Payment processing is handled securely by Paddle.com
• All fees are in USD unless otherwise specified
• Prices are subject to change with 30 days notice

7.3 Refunds

We offer refunds under the following conditions:

• Requests made within 24 hours of initial purchase
• 30% processing fee applied to unused credits
• Refunds processed within 5-10 business days

7.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. No partial refunds are provided for unused time.

8. Team Subscriptions

ENTERPRISE plans include team collaboration features:

• Team owner purchases the subscription and manages members
• Team members share a credit pool (20,000 credits for ENTERPRISE)
• Members receive unlimited project creation regardless of their personal plan
• Team owner can invite/remove members at any time
• Team owner is responsible for all billing and usage

9. Acceptable Use Policy

You agree NOT to use Flexty.AI to:

9.1 Prohibited Activities

• Generate illegal, harmful, or fraudulent content
• Violate intellectual property rights of others
• Attempt to hack, reverse engineer, or exploit the platform
• Scrape, crawl, or automate access to the Service
• Distribute spam or malicious content
• Resell or redistribute access to the platform
• Create content depicting violence, hate speech, or explicit material
• Impersonate others or provide false information

9.2 Content Guidelines

Do not include personally identifiable information (PII), confidential business data, or sensitive personal information in your prompts. We are not responsible for information you voluntarily include in prompts.

10. Termination

10.1 Termination by You

You may terminate your account at any time by:

• Contacting support at [email protected]
• Requesting account deletion from your account settings

Upon termination, your personal data will be deleted within 90 days in accordance with our Privacy Policy.

10.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Your account poses a security risk
• We are required to do so by law

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties regarding availability, reliability, or uptime
• Warranties regarding accuracy or quality of AI-generated content
• Warranties that the Service will be uninterrupted or error-free

Flexty.AI is not a substitute for professional design advice or development services. You are solely responsible for evaluating the suitability of generated content for your purposes.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Flexty.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Cost of substitute services
• Damages arising from service interruptions

Our total liability for any claims related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

13. Indemnification

You agree to indemnify, defend, and hold harmless Flexty.AI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your generated content or designs
• Your violation of these Terms
• Your violation of any third-party rights

14. Dispute Resolution

14.1 Informal Negotiation

Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting [email protected]. We will attempt to resolve disputes within 60 days.

14.2 Arbitration

If informal negotiation fails, disputes will be resolved through binding arbitration rather than in court, except for:

• Small claims court matters
• Intellectual property disputes requiring injunctive relief

14.3 Class Action Waiver

You agree to bring claims only in your individual capacity, not as part of any class, consolidated, or representative action.

15. General Provisions

15.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.2 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.3 Assignment
